Chapter 1 General provisions

1.1) This Rule was created on the basis of art. 4 Laws Transport Law of Poland dated November 15, 1984. (Journal of Laws 2000, No. 50, paragraph 601, as later amended).
1.2) The following terms are used in the Rules:

A) The carrier is the company Bialystok Express with office 15-237 Bialystok, Mitskevich St., 80/2, as well as ChTUP ClassTour with office 230025 Grodno, Zamkovaya St., 11-205
b) Passenger - a person using the Transportation Service provided by the Carrier on the basis of paid tickets.
c) Contract of carriage - an agreement concluded between the Carrier and the Passenger at the time of booking a seat on the bus; on this basis, the Carrier undertakes to transport the Passenger and his luggage from the selected city to the destination for an agreed amount of money.
d) Transportation service – transportation service by vehicle on the day booked by the passenger.
e) Electronic ticket - a document giving the Passenger the right to use the Transportation Service during a designated period, at a specific time and for an agreed and paid price. The electronic ticket is printed by the Passenger from the Internet ticket sales system.
f) Vehicle - a road vehicle used by the Carrier to provide the Transportation Service.
g) Internet ticket sales system – a system that allows Passengers to purchase a ticket for a specific Carrier Vehicle and print an Electronic ticket. The system works on the website website


Chapter 2. Travel reservation and ticket purchase

2.1) Reserving a seat through the Internet ticket sales system means concluding a Contract of Carriage and accepting the Rules described here.
2.2) Transportation service means the final reservation of a seat with the need to make payment through the Internet ticket sales system.
2.3) The Carrier allows payment in cash in Vehicles only if there are free seats on the bus. The price for payment in cash is set by the Carrier.

Chapter 3. Trip

3.1) The passenger must arrive at the stop indicated in the schedule no later than 10 minutes before departure.
3.2) The passenger must take the seat indicated on his ticket.
3.3) The passenger must have a printed Electronic Ticket. The carrier reserves the right to refuse a passenger a trip if there is no printed ticket.
3.4) A passenger who has concluded a contract of carriage on the route Grodno - Bialystok - Grodno valid for one day has the right to use the "Hop-On-Hop-Off" service:

A) get off at any stop of the Carrier in Bialystok indicated in the schedule.
b) board the Carrier’s bus at any stop in Bialystok indicated in the Carrier’s schedule.
c) use any Carrier's Vehicle while traveling between stops in Bialystok.
d) the number of boardings and alights from the Carrier's Vehicle is not limited until the time of departure from Bialystok indicated on the Passenger's ticket.
e) after the departure time of the Passenger indicated in the return ticket on the route Bialystok - Grodno, the Hop-On-Hop-Off service ceases to operate.

3.5) The Passenger is obliged to observe the rules of order in transport and follow the instructions of the driver of the Vehicle.
3.6) The Passenger is responsible for damage caused to the Carrier (including damage to the property of the Vehicle) and other Passengers according to the general rules described in the Civil Code.
3.7) A passenger who intentionally or unintentionally polluted the Vehicle is obliged to pay the Carrier a price equivalent to the damage caused, but not less than 500 Polish zlotys (in words: five hundred Polish zlotys).
3.8) If the Vehicle has seat belts, the Passenger must be fastened with these belts throughout the trip.
3.9) A child under 12 years of age and less than 150 cm tall must be transported in a child seat or other device designed for transporting children. The person accompanying the child must pre-book or independently provide such a seat for the child. The child must remain buckled in the safety seat for the entire trip.
3.10) The Carrier has the right not to allow the passenger into the Vehicle cabin or to refuse further travel without returning the funds spent by the Passenger on the ticket, if the Passenger:

A) does not comply with the Transportation Rules described here,
b) is in a state after consuming alcoholic beverages or under the influence of mind intoxicants.
c) behaves defiantly towards other passengers or the driver.

3.11) The legal consequences of the events listed in section 3.9 of this paragraph are covered by the passenger. The Carrier's use of the powers specified in this paragraph does not entitle the passenger to demand any compensation or reimbursement of expenses for booking and purchasing a ticket.
3.12) Drinking alcoholic beverages, smoking and using drugs is prohibited in Vehicles.
3.13) The carrier will strive to transport the passenger and his luggage on time, in accordance with the agreed schedule, but for reasons beyond his control, he cannot guarantee this.
3.14) The Carrier is not responsible for delays and their further consequences caused by administrative factors (border controls / police checks / etc.) or other factors beyond the control of the Carrier (for example, weather conditions, traffic jams).

Chapter 4. Baggage

4.1) Each piece of passenger's luggage carried in the luggage compartment must be signed with the passenger's name, in accordance with your ticket. The responsibility to sign the luggage lies with the Passenger.
4.2) The passenger has the right to free baggage in the amount of 1 piece and weighing up to 40 kg, with a maximum size of 50x50x80 cm, as well as hand luggage specified in paragraph 4.3 of this chapter.
4.3) A passenger can take luggage weighing up to 10 kg and dimensions that allow it to be placed freely under the seat for transportation into the cabin. The size of hand luggage should not inconvenience other passengers and prevent them from traveling.
4.4) If you are carrying excess baggage, you must order and buy an additional ticket in advance. An additional ticket entitles you to carry an additional 2 pieces of baggage with a total weight of up to 40 kg and a maximum size of each baggage of 50x50x80 cm, as well as one piece of hand luggage with a maximum baggage weight of 5 kg and a maximum baggage size of 60x40x20 cm.
4.5) When transporting sports equipment such as skis, surfboards, you must purchase an additional ticket.
4.6) The carrier has the right to refuse to accept baggage if it does not meet the requirements set out in this document.
4.7) Any unusual baggage must be reported by telephone no later than 17:00 on the day before departure.
4.8) The Carrier's liability for baggage transported in luggage compartments is limited to 1000 zlotys. In the case of transportation of goods of greater value, in particular, electronic equipment, the passenger insures them independently and informs the driver about this fact when handing over the luggage.
4.9) The carrier is not responsible for luggage and items outside the luggage compartment.
4.10) The carrier is not liable for damages for loss or damage to transported cash, jewelry, securities, electronic equipment and scientific, artistic or collector's items.
4.11) Items left in vehicles due to forgetfulness or other reasons are not subject to the protection and liability of the Carrier.
4.12) Passengers may submit complaints regarding baggage carried in the baggage compartment in writing to the carrier. A necessary condition is an oral complaint to the driver at the time of unloading the luggage and receiving from him a written confirmation of the complaint indicating the type of damage that occurred.

Chapter 6. Complaints

6.1) Claims arising in connection with the implementation of the contract of carriage should be sent to the carrier only in writing. The person authorized to file complaints is the passenger or his legal guardian. Complaints filed by third parties will not be considered. When filing a claim, you must provide your order number.
6.2) Complaints about services must be submitted to the carrier no later than within 2 months from the day the service was performed.
6.3) All complaints are considered within 14 working days from the date of receipt by the Carrier of a written complaint, taking into account situations in which there is a need for additional explanation from the Passenger.

Chapter 7. Refusal of transportation services

In order to return a ticket, no earlier than 600 minutes before the bus departure, the passenger must use the “Change” section in the form on the main page of the site.

Chapter 8. Personal data security policy

8.1) in accordance with Regulation 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of personal data (hereinafter referred to as GDPR), we guarantee the confidentiality of the Passenger’s personal information that comes to us through the online ticket sales system.
8.2) The seller guarantees that the buyer’s personal data will be processed solely for the purposes of the contract and for the seller’s marketing purposes.
8.3) In the cases and under the conditions specified in the GDPR, the Buyer has the right to demand that the processing of his personal data be temporarily or permanently suspended or deleted if it is incomplete, out of date, untrue or collected in violation of the law or is no longer necessary for the purposes with whom they collected, and also has the right to submit a written request to terminate the processing of his personal data.
8.4) The seller will not process or provide third parties with information about the buyer and his orders.

Chapter 9. Final provisions

In case of unregulated provisions and not described in these Regulations, the following should be applied: Law of November 15, 1984 Transport Law of Poland (consolidated text of the Legislative Journal 2000, No. 50, paragraph 601, with later amendments), Law of April 23, 1964 Civil Code of Poland ( Legislative Bulletin of 1964, No. 16, pos. 93; with subsequent amendments.)
